Adnan writes that he was looking through this Jet magazine and he does a double take because the girl looks so much like Hae. Even her watch looks like Hae’s watch. Adnan writes: Take a look at it and tell me what you think. I hope I’m not going crazy.

  • Motion for new trial denied: This motion was filed March 6 by Gutierrez. Dorsey didn't argue in support of this motion. He may not have been aware of it. Even Heard was surprised by the lack of response from Dorsey as to the motion for new trial.

  • Adnan Syed's Appeal filed in Court of Special Appeals (CoSA) MD. Issues raised:

    • a) Prosecutorial misconduct & Brady rule
    • b) Did court prevent Adnan from presenting evidence
    • c) Hearsay based on prejudicial nature of Hae's letter
    • d) Admission of Hae's diary
  • Maryland law allows only 10 years from the date of sentencing to file the PCR motion.

    • The state has a strong argument against federal habeas corpus on the Asia claim, because Asia's affidavit was obtained in 2000, so there is no justification for waiting another decade to start the PCR action about that issue.

    • Adnan's petition for post conviction relief should have been filed within one year of this date.
    • Inexplicably, Adnan waited seven years between this date and filing for post conviction relief. Maryland law allows no more than 10 years from sentencing to file for PCR. Asia's affidavit was obtained in 2000, so that can't be the reason for waiting seven years.
    • Update: Rabia wrote in her book that Adnan felt "burned" by the system, exhausted of funds, and didn't want to use up his last available option. He wanted to hold onto hope.
    • Turns out, Rabia lied to the readers of her blog when she wrote that Adnan had to wait 10 years to apply for post conviction relief. She knew Adnan could file right away, if he wanted, and she knew why he waited.

    • He is not going to pursue the brain mapping idea presented by Chris Flohr.
    • Rabia writes in her book that they didn't pursue this brain mapping idea because Justin Brown wouldn't want anything distracting from the PCR. Trouble is, Justin Brown hadn't even graduated from law school by the time of this letter.

    • Kandra has only been able to visit Adnan four times in the year or so that they have been married.
    • Once at Adnan is at Supermax/Cumberland, Kandra never sees Adnan again.

  • The 10 year deadline to file the PCR approaches

  • Asia: In the late spring of 2010, I learned that the Syed defense team was attempting to contact me. I was initially caught off guard by this and did not talk to them.

  • Serial, Episode 1: Asia's fiancé comes to the door, opens it part way, tells the investigator that she cannot speak to Asia, but that from what he knows of Adnan's case, Adnan is guilty and deserved the punishment he got.

  • Rabia: Adnan’s PI returns with terrible news. Asia won’t testify. The PI never spoke to her, but her fiance made it very clear, in a very nasty way that suggested an anti-Muslim prejudice, that Asia would not be involved and to leave them alone . . . Faced with a tough decision, [Justin Brown] decides to submit [Asia's] letters but not subpeona her for the appeal hearing.

  • According to Rabia, Justin Brown asks Adnan to take a polygraph test to determine the likelihood that he is lying about having asked Gutierrez for a plea deal. According to Rabia, Adnan passes.

  • Seven Years After Appeal Denied. Adnan could have filed for post conviction relief at any time during these past seven years.

  • Asia has already decided not to testify, earlier in May, before speaking to Urick.

  • Attoney Justin Brown files for Post Conviction Relief (IAC) Syed asks for new trial because Trial counsel (Cristina Gutierrez), Sentencing counsel (Charles Dorsey), and Appellate counsel (Warren Brown) ineffective for:

    • 1) Failing to establish a timeline disproving State's case
    • 2) Failure to investigate alibi witness
    • 3) Failing to move for new trial based Asia exonerating Adnan
    • 4) Failure to cross-examine Debbie (deficient)
    • 5) Failing to approach state for plea deal sought by Syed;
    • 6) Failing to advise Syed of option to request change of venue
    • 7) Failing to investigate Jay
    • 8) Warren Brown failure to raise prejudicial nature of cell tower evidence upon appeal
    • 9) Charles Dorsey's failure (at sentencing) to to request that the motion for sentence modification be held in abeyance.
  • Four years later, on October 18, and November 18, 2014, Rabia would lie to the readers of her blog. Rabia claimed that Adnan had to wait 10 years to file the PCR. Not true. The defendant has ten years to file to file for post conviction relief, but cannot file it AFTER 10 years.

    • In her book, Rabia makes it clear that she and Adnan knew all along that they could file for PCR right after the appeal was denied, and that she lied to the readers of her blog.

  • Years later, Rabia would tell the readers of her blog she she only had Urick's testimony, and didn't have her testimony, Shamim's or Adnan's. In 2015, redditor /u/stop_saying_right filed for, paid for, and uploaded the entire PCR for everyone to read.

  • Rabia says she watched the documentary "West of Memphis," looked up reporters who covered Gutierrez's disbarment, and found Sarah Koenig. Rabia's original intent was that media attention could influence the judge's decision in the PCR.

  • Rabia sends a letter to Sarah Koenig, asking her to take a look at the case. Rabia claims the police and prosecutors knew Adnan was innocent, and Gutierrez threw the case for money.

August 29, 2013

  • Rabia hastily sets up an LLC in Maryland, even though she is not licensed to practice law there.

    • In anticipation of a meeting with Sarah Koenig, Rabia sets up the appearance of a working office within an existing travel agency type space, across the street from Woodlawn High School.
    • Rabia wants Sarah to think this has always been her office, and that this is where she works.

August 30, 2013

  • Approximate: In her "office" across the street from WHS, Rabia meets with Sarah Koenig, leading Koenig to believe Rabia has had this office for a while.

Late September, 2013

  • Adnan receives a letter from Justin Brown saying that a reporter named Sarah Koenig wanted to do an interview. Justin wrote that he didn't think Sarah would waste time on a story if she didn't believe Adnan was innocent. Adnan receives the first letter from Sarah Koenig, a few days later.

  • By now, Adnan has received an introductory letter from Sarah Koenig. She sent him a pad and pencil and stamps. Adnan writes Sarah Koenig a letter about his story and case.

    • Adnan says he wasn't much bigger than Hae.
    • Adnan says that students weren't allowed to use the top parking lot. (several WHSers and Krista have said that students used the top parking lot.)
    • Adnan describes the route to the Best Buy but neglects to mention the back way.
    • Adnan implies that the October 31 break up was the final break up.
    • Adnan says that he and Hae would joke about two women calling him on his cell phone at the same time. (Only we know that Adnan's first, ever cell phone was activated the evening of January 12, and there are no calls on the call log that support this story.)
